Consider keeping Bernanke, top Romney adviser says

NEW YORK (Reuters) - Ben Bernanke received an unlikely defense of his work at the U.S. Federal Reserve by a top Mitt Romney adviser, who said on Tuesday that he should be considered for a third term as chairman.

Glenn Hubbard, economic adviser to the Republican presidential candidate, said he would advise a possible President Romney that Bernanke should "get every consideration" to stay on beyond January 2014, when the chairman's current term expires.

The comments may come as a surprise given Romney has said he would not reappoint Bernanke beyond 2014. Further, many top Republicans have blasted the Fed's aggressive policies since the Great Recession as overreaching and reckless.

"Ben is a model technocrat. He gets paid nothing for getting kicked around all the time. I think they ought to pat him on the back," Hubbard said in an interview, adding he has known Bernanke since they were "practically kids" and regularly speaks to him.

"I may or may not agree with him, but that's very different from saying I question his motives. I wish politicians would stop doing that," Hubbard told Reuters TV. (Reuters TV interview: http://reut.rs/SPSy4f )

The comments from Hubbard - who himself was considered for the Fed chairmanship under former President George W. Bush, who ultimately picked Bernanke - suggests there is at least some support for the head of the U.S. central bank within the Romney camp as it battles to unseat President Barack Obama.

Hubbard was quick to note his opposition to some Fed policies, including the large-scale bond buying programs known as quantitative easing, or QE. He said a third round of buying (QE3) is unlikely to happen and would have little effect on either the economy or the bruising election campaign.

QE3 would probably only slightly lower Treasury yields, which are already very low, Hubbard said. "I don't think that's what the doctor ordered for the recovery," he said at the Columbia Business School in New York, where he is dean.

Yet with U.S. economic growth stalling and unemployment stubbornly high at 8.3 percent, some economists expect the Fed to launch QE3 as soon as its next policy meeting on September 12-13. Bernanke could set the stage for a new purchase program at a speech in Jackson Hole, Wyoming, on August 31.

But on the eve of the November 6 presidential election, such a controversial move to boost the economy would almost certainly draw criticism from conservatives who already feel the central bank is an overly powerful agency that lacks transparency.

Paul Ryan, Romney's vice presidential running mate and a harsh critic of the Fed's ultra loose monetary policy, backs exposing those policy decisions to a congressional audit, and he supported legislation that would strip the Fed of its mission to seek maximum employment.

Romney has said QE3 would not do much economic good, and he too backed an audit of the Fed, though it is unclear whether he would want to extend that to monetary policy - as Ryan does - which could be seen as undermining the central bank's independence.

Hubbard, who was chairman of the White House Council of Economic Advisers under Bush, said Congress is right to consider forcing the Fed to explain policy decisions. But "the idea of putting them more under the microscope of literally auditing decisions - I don't think so," he said.

Thousands being moved from China's Three Gorges - again

HUANGTUPO, China (Reuters) - China relocated 1.3 million people during the 17 years it took to complete the Three Gorges dam. Even after finishing the $59 billion project last month, the threat of landslides along the dam's banks will force tens of thousands to move again.

It's a reminder of the social and environmental challenges that have dogged the world's largest hydroelectric project. While there has been little protest among residents who will be relocated a second time, the environmental fallout over other big investments in China has become a hot-button issue ahead of a leadership transition this year.

In some cases, protests have forced the scrapping of multi-billion dollar projects. The most recent was on July 28, when Chinese officials cancelled an industrial waste pipeline after anti-pollution demonstrators occupied a government office in the eastern city of Qidong, destroying computers and overturning cars.

"If the government says you have to move, you move," said Shuai Linxiang, a 57-year-old woman among 20,000 people to be relocated from Huangtupo, where they were resettled in 1998. "We can't oppose them."

The Three Gorges dam was completed in July when its final turbine joined the national grid and the facility reached its full capacity of 22.5 gigawatts, more than enough to power Pakistan or Switzerland.

As the dam was being built on the Yangtze River, in central Hubei province, authorities moved 1.3 million people who lived in what became its 1,045 sq km (405 sq mile) reservoir, an area greater in size than Singapore.

Reuters was recently given a rare tour of the 181-metre (600-ft) tall dam and reservoir. In a sign of how sensitive the fresh relocations are, plainclothes security men and people who identified themselves as officials from the "news department" followed Reuters reporters around the area for three days, hindering interviews by intimidating locals with their presence.

Since word of the new resettlement has filtered out, Shuai and her neighbors have become known in China as "Three Gorges' immigrants, once again".

They were moved to Huangtupo in the late 1990s and early 2000s, when the reservoir began to consume their original town.

Besides 20,000 people in Huangtupo, another 100,000 may be moved in the next three to five years because of geological risks, Liu Yuan, an official with the Ministry of Land and Resources in Beijing said in April, according to state-run China National Radio.

The number of "geological hazards" had risen 70 percent since water levels in the reservoir reached a maximum of 175 meters (574 ft), he said, without elaborating, although he was believed to be referring to landslides. Liu could not be reached for comment.

Landslides in Huangtupo had been exacerbated by changes in water levels in the reservoir, said Fan Xiao, a geologist for a government-linked institute in southwestern Sichuan province, who studied conditions there in 2006.

Dam officials lower water levels by as much as 30 meters during the summer in anticipation of floods, and raise them in winter. The change softens the slopes along its banks, Fan said.

"It's like a person who's standing in place, if you push and pull him, he'll definitely not be as stable as before," he said.

For hundreds of thousands who live on the banks, landslides can wipe out homes. The government has not given recent statistics of deaths from landslides but at least 48 people were killed in 2007 across the area, according to state media.

Three Gorges officials defend the facility and say it has brought development to an otherwise poor region.

Wang Hai, deputy head of the operations department at the complex, said the dam did not increase the risk of landslides, which he said were not unusual along reservoir banks.

"The stability of the reservoir banks is not worse than before," he told Reuters in an interview.

Besides forced resettlement, the dam has been criticized for its polluted waters. Hundreds of factories, mines and waste dumps were submerged over the years and additional urban growth along the reservoir has caused waste water discharge to double between 2000 and 2005, according to International Rivers, a California-based NGO that aims to protect rivers.

An island of waste was floating in the dam's brown waters when Reuters visited.

"After the Three Gorges dam was built, the deterioration of the water quality is very obvious and it is irreversible," said Ai Nanshan, a professor of environmental sciences at Sichuan University. "The water flow has slowed down, so its ability to purify itself has deteriorated."

The dam has accelerated development along the reservoir by 50 to 100 years, said Chen Lei, another official in the Three Gorges operations department.

"If not for the Three Gorges project, their (residents') lives would be confined as before, deep in the mountains, a relatively backward state of poverty," he said.

RECONSTRUCTION

Authorities are building a new town nearby called Shennongxi to house residents of Huangtupo.

Shuai was among the first to move to one of the many seven-storey apartment blocks painted in cream, pink and grey colors that stand amid scorched red earth. If you don't move, we won't care about you, she said a local official told her last year.

For income, Shuai sells groceries from her apartment. She was given 5,000 yuan ($790) as a "reward" for being among the first to move, according to a June 2011 government document she showed Reuters; 200 yuan per person in her family and 1,000 yuan in "moving fees".

Officials did not respond to repeated requests for comment on the forced relocation and compensation given to residents.

The local government will offer a new apartment and cash as compensation for resettlement, it said in a December 2009 document explaining the scheme, without providing details of the amounts.

It will only compensate residents according to the floor area of their previous apartments, but will not pay extra if the apartment in Shennongxi is bigger than their previous homes.

Residents who "reject the relocation or delay relocating" or "make unreasonable demands for compensation again" after being compensated will receive a warning, the local government said.

Shuai reckons 30 households have moved to Shennongxi. Her grandson, who attends school in the town, lives away from his entire family because there's virtually no transport.

"By moving here, we have no way to survive," she said.

In Huangtupo, many residents await the order to resettle.

"The (first) time when we moved, our home, our land, our fruit trees, they were all finished, they were all drowned by the water," said Li Huanggui, 94, sitting in her home in the only apartment block left standing amid demolished buildings.

A shop owner, surnamed Qing, has been told she has to move in the second half of the year. She relocated the first time in 2000 when water from the reservoir flooded her home.

Asked if she thought the government would compensate her this time, she scoffed.

"The more we move, the poorer we get," she said. ($1 = 6.3586 Chinese yuan)

MILWAUKEE (AP) ? Remember when suitcases had to be carried instead of rolled? Or when an airline ticket was a booklet of pages separated by carbon paper? Maybe you remember when Lou Gehrig held the Major League record for consecutive baseball games played.

This year's college freshmen don't.

They never lived in a world where Kurt Cobain was alive or an NFL team played its home games in Los Angeles. The Class of 2016 has no need for radios, watches television everywhere except on actual TV sets and is addicted to "electronic narcotics."

These are among the 75 references on this year's Beloit College Mindset List, a nonscientific compilation is meant to remind teachers that college freshmen, born mostly in 1994, see the world in a much different way.

The students are also accustomed to seeing women in position of leadership. They were born at a time when Madeline Albright was serving as the first female U.S. secretary of state, and women have held the position for most of their lives.

And the old Hollywood stereotype of ditzy blonde women has given way to one of "dumb and dumber males," according to the list.

"In general, there was always the complaint that it was too slow for women to get to positions of responsibility," said Ron Nief, one of the two Beloit College officials who compiles the list. "Now the question is, 'What took so long?'"

The compilation, released Tuesday, has been assembled every year since 1998 by Nief and Tom McBride, officials at the private school in southeastern Wisconsin. Over the years it has evolved into a national phenomenon, a cultural touchstone that entertains even as it makes people wonder where the years have gone.

The lists have begun attracting attention from government agencies, athletic organizations and other groups that want to know how the younger generation thinks. Nief and McBride will be sharing their insights with employees of NASA Goddard Space Flight Center in Greenbelt, Md., in October.

The new generation gets a lot of its news from Jon Stewart's "The Daily Show." But if they miss an episode, they can always get instant news from YouTube (No. 5 on the list).

Here are some other items to make you feel old: These teens weren't born when "Pulp Fiction" came out. Instead of asking who shot J.R., they wanted to know who shot Montgomery Burns. And to them, "Twilight Zone" is about vampires, not Rod Serling.

But Thorin Blitz, 18, disagreed with that item. He said it's 13-year-old girls who watch "Twilight."

"I've seen quite a few 'Twilight Zone' episodes," said the incoming freshman from Charleston, Ill. "Most of us know what that is."

Similar list items have drawn criticism in previous years. Some teens were insulted by the insinuation that they had no knowledge of events that happened before they were born, as if they had never studied history. So Nief and McBride have softened the tone, replacing "They don't know about..." with "They never experienced..."

The theme of last year's list was how wired the incoming class was. This year's class includes students who might be bitter at the previous generation, Nief said. While their elders went to college in good times and had jobs waiting for them, these students grew up watching their parents worry about unemployment and foreclosures.

That sentiment was captured in item No. 16, which notes unemployment has risen 2 percent in their lifetimes.

But they also live in an era of potential. Gene therapy has always been available, and they don't waste time with outdated technologies like radios and point-and-shoot cameras.

They're also less likely to identify with a specific religion. McBride noted that many church denominations have been losing members, while membership is up at nondenominational churches.

"When I teach Shakespeare or Milton there are a lot of biblical allusions, and I have to explain them all," said McBride, an English professor.

India cracks down on Internet after communal violence

NEW DELHI (Reuters) - India pressed social media websites including Facebook and Twitter on Tuesday to remove "inflammatory" content it said helped spread rumors that caused an exodus of migrants from some Indian cities last week.

The government said in a statement it had already blocked access to 245 web pages it said contained doctored videos and images, and the telecommunications secretary, R Chandrashekhar, threatened legal action against the websites if they did not fully comply with the requests to take down the offending pages.

Chandrashekhar told CNN-IBN television that Google and Facebook had largely complied with the government's requests while the response from Twitter had been "extremely poor", though he added that this "may be in part because they don't have an office in India".

Twitter was not immediately available for comment.

"A lot of inflammatory and harmful content/information has been found to be appearing on the social networking sites hosted outside the country," the government statement said.

The government met representatives of social media sites on Friday to push its case, it said.

The crackdown will likely rekindle a debate on freedom of speech and censorship of the Internet in the world's largest democracy.

Media group Reporters Without Borders said in March that India was increasing pressure on Internet service providers to supply users' personal data. Google says that between July and December 2011 there was a 49 percent jump in requests from India for content to be removed from its services, compared to the previous six-month period.

In a move that will likely add to their concerns, the government on Tuesday blocked a number of Twitter accounts that spoof the prime minister, local media reported.

"The government is for free information. There is no question of anything being censored here. But that does not mean there are not limitations," a senior official in the Ministry of Home Affairs said, adding that authorities were trying to identify those responsible for posting the inflammatory material.

Thousands of students and workers from India's northeast fled Mumbai, Bangalore and other cities last week fearing retaliation for violence against Muslims in the remote tea-growing state of Assam after threatening mobile phone text messages and website images sowed panic.

Clashes between indigenous people in Assam and Muslim settlers from neighboring Bangladesh have killed nearly 80 people and displaced some 300,000 since July.

INDIA BLAMES PAKISTAN

A cyber law expert said blocking web pages was "like putting a band-aid on a leaking roof". "It's a strategy that is doomed to failure from the word go. There are so many indirect ways to access the Net," said Pavan Duggal.

India has not released details of the blocked pages but said in a statement that "international social networking sites" had indicated that much of the content had been uploaded from neighboring Pakistan, a long-time foe with which it has fought three wars.

An industry executive, who did not wish to be named, said companies "cannot share such information with the government".

"It's beyond their jurisdiction. This is an international issue, which the government is well aware of," said the executive.

Google and Facebook said they were cooperating with the government.

"We have received requests from Indian authorities and agencies and are working through those requests and responding to the agencies," Facebook said in a statement released by their Indian representatives.

Google has accepted the government's request to take down some content, while discussions are continuing on other requests, said a source with knowledge of the developments.

"We understand the gravity of the situation, strongly condemn acts of violence and continue to work closely with relevant authorities," Google spokeswoman Paroma Roy Chowdhury said in a statement.

Media reports said many of those panicked by the fear-mongering text messages and Internet postings have begun returning home this week.

Sudan plane crash kills up to 31 including minister

KHARTOUM (Reuters) - Up to 31 people including at least one Sudanese minister were killed when a plane taking them to an Islamic festival crashed in the south of the country, an official and state media said on Sunday.

The plane went down into mountains around Talodi, a town in the border state of South Kordofan, while bringing a government delegation there to celebrate the festival marking the end of the Muslim holy month of Ramadan, state news agency SUNA said.

SUNA said 26 passengers were killed and that the dead included ministers but did not name them.

Abdel Hafiz Abdel Rahim, a civil aviation spokesman, told Reuters that 31 people were killed including the crew, but had no details about their identities.

Arabic satellite channel Al Arabiya said the plane was carrying Guidance and Endowments Minister Ghazi al-Sadeq. Al Jazeera reported two ministers were on board, but did not name them.

Citing Sudanese authorities, Al Jazeera reported that security personnel and a media team were also killed in the crash. The report did not say whether the plane involved belonged to the state-owned Sudan Airways or another carrier.

There have been several crashes in recent years involving Sudan Airways, which has been worn down by years of U.S. sanctions and other issues.

A Sudan Airways cargo plane crashed when it was taking off in the United Arab Emirates in 2009 and another cargo plane crashed shortly after take-off from Khartoum in 2008.

Oil-producing South Kordofan borders South Sudan, which seceded over a year ago. The border state has been the site of an insurgency since shortly before South Sudan's independence.

Sudan's government accused rebels of killing a state official and seven other people there in July. A spokesman for the main rebel group in the area, the Sudan People's Liberation Movement North, said the insurgents had nothing to do with the plane crash on Sunday.

As cloud-based gaming service OnLive struggles to reform itself and cope with its pricey infrastructure, HTC's $40 million investment made last year will disappear completely, according to a recent filing to the Taiwan Stock exchange. OnLive began streaming its gaming selection to Android smartphones and tablets at the end of the same year but we never saw any exclusive features for HTC hardware. Following some tough financial results, it packed up its Korean office and recently returned half its stake in Beats, although its involvement with OnLive had never resulted in the same degree of publicity.

Retailer Best Buy has announced that Frenchman Hubert Joly is its new CEO. David Strasser, analyst at Janney Capital Markets, offers his view on what the announcement means for the stock.

Best Buy has named Carlson executive Hubert Joly as its new president and chief executive, hoping to profit from his expertise in revitalizing companies as the electronics retailer struggles in the face of stiff online competition.

The world?s largest consumer electronics chain said Joly, who was born and raised in France, will take up his new role in early September when he is expected to secure a visa.

Joly is the former CEO of Carlson, a global hospitality and travel company based in Minneapolis, Minn. He will replace Mike Mikan at Best Buy, who has served as interim CEO for the retailer since April.

Best Buy is currently engaged in a takeover fight with its founder and former chairman. Richard Schulze has offered to buy the struggling electronics retailer and take it private in a deal that values the company at more than $8.1 billion.

Best Buy said it offered Schulze an opportunity to conduct due diligence on the company to pursue his plan to acquire outstanding shares in the company on Friday, but Schulze declined the offer.

Schulze, 71, stepped down from the company after an internal probe found he failed to tell the retailer?s board about allegations that former chief executive Brian Dunn was having an inappropriate relationship with a 29-year-old female subordinate.

Dunn, who resigned in April, ?violated company policy by engaging in an extremely close personal relationship with a female employee that negatively impacted the work environment,? according to an internal investigation by the retailer?s audit committee.

Best Buy has struggled in recent years as customers have migrated to Apple and online retailers such as Amazon.com. The retailer is expected to report results for its most recent quarter on Tuesday. It has posted sales declines in seven of the last eight quarters.

Joly led the restructuring and growth of Vivendi?s video game?s business -- now part of Activision Blizzard -- from 1999 to 2001. He also drove the turnaround of technology company EDS, which is now part of Hewlett Packard, in France from 1996 to 1999, Best Buy said.

?Hubert was an outstanding candidate for this position and I am confident he will be a great fit for Best Buy,? said Hatim Tyabji, chairman of the Best Buy Board, in a statement.

?Hubert?s range and depth of experience in transforming companies is exactly what the company needs at the moment, as is his energetic, imaginative and experienced leadership in executing strategies,? he added.

Jake Locker?s first start with the Titans did not begin smoothly, but Locker eventually shook things off and marched Tennessee downfield on an impressive touchdown drive.

Locker, the second-year quarterback who is getting an opportunity to show what he can do with the first-string offense, struggled early on against the Buccaneers. And running back Chris Johnson struggled as well.

On the second possession, Locker made a terrible decision on third-and-long, rolling right and then throwing against his body into coverage, where his pass was intercepted by Tampa Bay?s Ahmad Black and returned to the 2-yard line, setting up a Buccaneers touchdown.

And the Titans? third possession was another three-and-out, concluding with a Locker incompletion.

But the Titans? offense finally got things going on their fourth drive. Locker showed that he?s capable of making accurate throws on the run, completing an 11-yard pass to Craig Stevens, and Locker also ran for 21 yards. Johnson had a 10-yard run and a 14-yard run, and the latter run got the Titans into the end zone.

Locker has shown that he can make plays. The question is whether he can make plays consistently enough to beat out Matt Hasselbeck for the staring job in Tennessee.

JOHANNESBURG ? Expelled politician Julius Malema blames senior members of the governing African National Congress for police killing 34 striking miners this week, and says South African police had no right to fire live ammunition at the men.

The youth leader, who was expelled from the ANC earlier this year, was welcomed as a hero on Saturday by thousands of strikers. He is the first politician to address them at the site and says he has come because the government has turned its back on them.

Strikers complained that President Jacob Zuma had not come to them when he flew to the area Friday and visited hospitalized miners who were wounded in Thursday?s shootings.

Fatherhood: The Future ... and Past



Patrick has a long and glorious future in front of him. That does not mean that I have a clue about my future as a parent. There were so many things that I was sure of before I had a child.

I got an e-mail this morning from the?LEGO Learning Institute, Denmark. They want to use one of my images (Adjusted Lego Heart) in a video about "Systematic Creativity" ... actual academic research, to be used both internally and externally. I cannot even remember when I got to take a photograph that did not have Patrick in it ... and I love it!

Now, I am sitting home ... Patrick is asleep in his crib ... on a Friday morning (my work schedule has aligned with the day-care in-service day ... I never knew they had such a thing; once a month and we have to arrange for one of us to be home). I've got an ear cocked for sounds from above ... praying that today will be a fun day.

Maybe this afternoon, we will invite Papap for lunch at McDonald's and spend some time over there ... that's as far ahead as I can think.

The Voice UK 2013: Annie Lennox to join as coach?

Annie Lennox is reportedly in the running to become a coach on The Voice UK next year.

BBC bosses are understood to be after at least one new coach after Jessie J quit the show, while they may also need a replacement for Sir Tom Jones.

The 71-year-old said he did want to return, but only if he approved of the other coaches!

But we?re not sure he?ll have any problems with Annie.

According to The Sun, producers hope that Annie?s years of experience will make her a good signing alongside the other coaches.

A source told the newspaper today: ?Annie would be a great signing. She really knows her eggs.

?Last year?s judges were great but it would be nice to inject some new blood into the panel too.?

The source added: ?Last year Sir Tom proved that experience really counts and Annie?s got that in spades. She?s not afraid to give an opinion either.?

Both Black Eyed Peas star Will.i.am and The Script frontman Danny O?Donoghue are expected to be returning next year.

Sir Tom Jones was the first winning coach back in June, with Leanne Mitchell topping the vote in the final.

Her debut album is due out later this year.

Ex-leader of Border Patrol union is accused of fraud

LOS ANGELES ? The former president of the National Border Patrol Council was indicted Thursday on suspicion of diverting union funds to finance personal travel, tickets to sporting events and hard drives used to store an extensive pornography collection.

Terence J. ?T.J.? Bonner, 59, diverted hundreds of thousands of dollars from dues-paying union members during more than two decades as president of the organization, which represents more than 14,000 U.S. Border Patrol agents, federal prosecutors said.

Bonner is accused of submitting bills and receiving payment for nonunion activities during his many trips across the country. The charges include conspiracy to commit wire fraud and wire fraud. He was allegedly assisted by a former top union official who was not named in the indictment.

?These false (reimbursement) claims included periods of time when Bonner was actually visiting his mistress in Chicago or family members, as well as trips to attend non-Union activities, such as hockey games and other sporting events,? read the indictment issued by a federal grand jury in San Diego.

Bonner, a resident of El Cajon, east of San Diego, is scheduled to be arraigned Monday. His attorney, Eugene Iredale, was unavailable for comment.

The charges shocked many in the agency, where union dues are about $56 a month. An outspoken border security hawk, Bonner was a frequent commentator on television news shows and testified before Congress. He traveled often and built a reputation as a strong advocate for safe working conditions and decent salaries. He also was a critic of the Obama administration?s immigration and border policies.

Bonner was credited with building up the union during the rapid growth in the border patrol ranks, turning it into one of the strongest in the federal workforce. ?He gave us credibility on Capitol Hill and the media and with other agencies,? said current union President George McCubbin.

McCubbin and others said Bonner, who retired in 2010, was a hard worker and widely respected. ?Apparently, I didn?t know him at all,? McCubbin said.

The indictment alleges that Bonner padded expenses, claimed wages for work he didn?t do, and made purchases unrelated to union activities. Among the items he bought were dozens of storage drives used for pornography, the indictment charges.

?Siphoning hundreds of thousands of dollars from hard-working fellow Border Patrol agents, many of whom put their lives on the line every day to protect this country, is a particularly troubling form of corruption that must be addressed,? said Laura Duffy, the U.S. attorney in San Diego.

Ever wonder how bars discover new products? More often than not, owners and/or employees attend trade shows where they meet and greet with liquor distributors and brand ambassadors while sampling the latest beers, wines and spirits.

On Wednesday, Aug. 15, Young?s Market of Hawaii held its Holiday Buying Show 2012 at the Hawaii Convention Center. With operations on Oahu, Maui, Kauai and Hawaii island, they?re one of the main liquor distributors in the state. And thanks to Christa Wittmier, the company?s special events and marketing director, I got an opportunity to explore this year?s show along with hundreds of others from the local food and beverage industry.

With more than 50 tables set up, some hosting multiple brands of alcohol and/or wine, there was plenty of booze to learn about ? and sample. Here are my favorite finds from the show.

Sub-Zero Hangar One:

While the three featured flavors of Hangar One vodka weren?t that memorable, getting a sample shot poured by a pretty young lady from a bucket filled with dry ice made it worth a stop at this table.

RumChata:

I?m not that big a fan of horchata, a Latin beverage with a milky consistency and typically made with sugar, cinnamon and vanilla. But Agave Loco Brands? RumChata had me instantly reevaluating that opinion. A smooth blend of Carribean rum, rice, sugar, cinnamon and vanilla, it has a creamy consistency with the flavor of a liquefied cinnamon roll.

I can see myself buying a bottle of this stuff around Christmas time and adding it to a carton of non-alcoholic egg nog to jazz things up.

The Balvenie DoubleWood:

I?ve only recently acquired a taste for Scotch after years of being content with stuff like Jack Daniels and Southern Comfort. Now that I know better, I?ve grown to enjoy the wood and smoke flavors that are often found in whisky made in Scotland.

This DoubleWood offering uses whisky aged first in traditional oak casks before being switched to European oak sherry casks that add a slight fruit note to the finished product. This stuff is mellow, smooth and very, very tasty. Definitely worth a try!

Western Spirits:

My favorite table this year was one featuring products by Kentucky-based Western Spirits. Brand reps were pouring samples of five liquors I had never seen before: Sam Houston Whiskey, Bird Dog Blackberry Whiskey, Whitetail Whiskey, Lexington Bourbon Whiskey and Tres Leches Triple Cream Liqueur.

My favorite of the group was the Lexington (can you tell I?m on a bourbon kick these days?), although I also liked the Bird Dog.

Sous Vide Tequila:

Leave it to Pint & Jigger owner Dave Newman to one-up everyone else in the room ? the former Nobu Waikiki bar manager used a sous vide machine to infuse the flavor of charred Jack Daniels barrel chips into a mixture of Maestro Dobel tequila, cassis, lemon and ginger-infused simple syrup.

Drawing upon the recipe for an El Diablo by David Power of Kauai?s The Feral Pig, Newman said the use of a sous vide machine provided the depth and flavor characteristics that used to only be possible via traditional barrel-aging. Instead of waiting weeks for the aging process to be complete, he?s able to cut the time down to just two days.

The end result? One of the best tequila-based cocktails I?ve ever had. Newman said the El Diablo will be on the menu at P&J soon, with other sous vide-inspired creations planned in the future.

Apple Sued over Playback Technology used in QuickTime and iPhone

EPL Holdings, a Delaware company run out of Palo Alto has filed a patent infringement lawsuit against Apple. The official filing with the court states that Enounce had entered into a non-disclosure agreement with Apple back in early 2002. The actual offer for their technology came in the following month at a low ball price that Enounce refused. EPL claims that Apple went ahead anyways and used the technology used in QuickTime and the iPhone.?

Factual Background Presented in the Complaint

?

Since before 1992, EPL and its predecessor in interest Enounce, Inc., have developed and continue to develop important technologies that allow consumers to play back digital media content, including audio and video, at variable speeds. Variable speed control is becoming as popular as volume control on digital media playback devices. Indeed, this technology has become increasingly prevalent in some of the most popular consumer electronic products currently on the market.

On or about January 28, 2002, Apple employee Tony Fadell requested a meeting with Enounce's founder, Donald J. Hejna, Jr., to discuss the playback technology. In response to Apple's request, on about February 5, 2002, Mr. Hejna and another employee, Howard Giles, met with Mr. Fadell and at least two other Apple employees at Apple's Cupertino, California offices and discussed Enounce's patented technology.

Apple and Enounce then entered into a non-disclosure agreement effective February 6, 2002, that expired on February 6, 2005. On or about March 19, 2002, Apple employee Aram Lindahl met with Mr. Hejna and again discussed Enounce's patented technology. At that Meeting, Mr. Hejna provided Mr. Lindahl with a copy of U.S. patent number 5,175,769 (the '769 patent). Within weeks of the March 19, 2002 meeting, Apple offered Enounce a de minimis $50,000 for a license to use Enounce's patented technology. Because Mr. Hejna and his colleagues believed that the offer fell woefully short of the value of their technology, Enounce declined Apple's offer.

Thereafter, and unbeknownst to Enounce, Apple began to extensively using Enounce's patented technologies by incorporating them into key consumer electronics products, including but not limited to the iPhone and iPad, on which Apple makes billions of dollars in U.S. sales annually. Apple took these actions with blatant knowledge and disregard for the legal rights of Enounce. Moreover, Apple began to advertise and tout the ability of its digital media players to play back media files at variable speeds, the precise technology found in Enounce patents. For example, Apple describes its QuickTime product as a "sophisticated media player" and further states, "want to speed through a movie or slow things down? Similarly, Apple instructs iPhone users to "set the playback speed" to play back media files at variable speeds using the technology found in Enounce patents.

While Apple enjoyed billions of dollars in sales, Mr. Hejna and his company have suffered and continue to suffer due to the inability to realize the full and fair value of the patented invention.

The filing by EPL presents two counts of infringement against Apple using patents 5,175,769 and 7,683,903. The complaint alleges that Apple's entire line of products including the iPhone, iPod touch, MacBook Air, MacBook Pro, Mac mini, iMac, Mac Pro infringe on their patents.

Cut the actual dough in half, and also work with one half at the same time.

(AP) ? Ecuador on Thursday granted political asylum to WikiLeaks founder Julian Assange, a decision that thrilled supporters but did not defuse the standoff at the Latin American nation's London embassy, where he has been holed up for almost two months.

Assange's recognition as a political refugee by Ecuador's left-wing government was a big symbolic victory for the embattled ex-hacker, but it did little to answer the question: 'How will he ever leave the embassy?'

"We're at something of an impasse," lawyer Rebecca Niblock said shortly after the news broke. "It's not a question of law anymore. It's a question of politics and diplomacy."

She said British authorities remained under the legal obligation to arrest Assange, 41, as soon as he set foot outside the embassy because he had been under strict bail conditions when he sought asylum at the embassy.

"He's in breach of his bail," she noted. "But I can't see Ecuador changing their position."

Staying in the embassy long-term "seems to be one of the few feasible options I can think of," she said, adding that the question of how long Assange could stand it in the embassy was not one she could answer.

The decision to grant Assange asylum was announced Thursday in the Ecuadorean capital of Quito by Foreign Minister Ricardo Patino, who said there were "serious indications" that the United States could threaten Assange's "security, integrity and even his life."

Assange's asylum claim centers on claims of sexual assault leveled against the WikiLeaks founder by two women he met while on a trip to Sweden in the wake of some of his organization's spectacular disclosures of U.S. intelligence material. The women accuse him in separate cases of molestation and rape, and Swedish authorities have been seeking his extradition since late 2010.

Assange, who denies the accusations, has expressed fears that the case is the opening gambit in a Washington-orchestrated bid to make him stand trial for his leaks in the United States ? something disputed by both by Swedish authorities and the women involved.

Patino said Thursday that it was clear that if Assange were extradited to the United States "he would not have a fair trial, could be judged by special or military courts and it's not implausible that cruel and degrading treatment could be applied, that he could be condemned to life in prison or the death penalty."

Patino's decision was warmly received by cheering pro-Assange demonstrators gathered outside the Edwardian-style embassy, just down the street from the famous Harrods department store.

"It must have been a tough decision for Ecuador because they had pressure," said Alejandra Cazas, an 18-year-old British-Bolivian citizen outside the embassy. "Now they have to watch out that he arrives to Ecuador safely."

How that could happen was anyone's guess Thursday. Legal experts debated whether Assange could get safe passage in a diplomatic car, escape in an oversized diplomatic bag, or slip out when police relaxed their guard.

Meanwhile the diplomatic repercussions rumbled on. In a mark of its anger over Thursday's asylum ruling, the Swedish Foreign Ministry said it had summoned Ecuador's ambassador over the decision.

"We want to tell them that it's unacceptable that Ecuador is trying to stop the Swedish judicial process," spokeswoman Anders Jorle said.

Swedish Prosecution Authority spokeswoman Britta von Schoultz said the investigation into Assange was still active.

"The prosecutor has decided, with the court's backing, to issue a European arrest warrant," she said. "When that decision has been made, it's difficult to rewind. For investigative reasons he needs to be here."

British authorities have also indicated little appetite for backing down. In a statement, the country's Foreign Office said it was disappointed by the decision to offer Assange asylum ? noting that he had exhausted every appeal possible to British authorities over the course of a roughly 18-month-long legal saga.

"U.K. authorities are under binding obligation to extradite him to Sweden," the ministry said in a statement posted to Twitter. "We shall carry out that obligation. The Ecuadorian government's decision this afternoon does not change that."

Britain has warned that it could use a little-known 1987 law that could give British police the right to enter the embassy to arrest Assange, though most legal experts called the move unlikely.

The inviolability of embassies "is a fundamental premise of international law," said Niblock, who practices at London law firm Kingsley Napley.

She said that if Britain carried through with the move, "it would threaten their embassy premises around the world."

FORTUNE -- "It's time for peace,"?Judge Lucy Koh declared in federal court Wednesday, the ninth day of the jury trial in Apple's (AAPL) high-stakes patent infringement suit against Samsung.?"I see risk here for both sides if we go to a verdict."

Christopher Carani, a partner at Chicago-based?McAndrews, Held & Malloy and an authority on design law, respectfully disagrees.

The risks for Samsung are well known, he says: Injunctions, delays, the need to design around Apple's patents, and the stigma of being known as a copyist -- not to mention billions of dollars in damages.

Apple, on the other hand, has little to lose by waiting for the jury's verdict. It's already spent the lion's share of the monstrous legal fees, and those who view the company as over-litigious are not likely to change their mind.

Besides, based on his reading of the transcripts, Carani believes the case is going Apple's way.

On the iPad:

Judge Koh already tipped her hand on the iPad design infringement charge when she granted Apple a preliminary injunction against the Galaxy Tab. And the parade of "prior art" Samsung's legal team trotted out Monday and Tuesday, according to Carani, is not likely to?persuade a jury that Apple's tablet design patent is invalid:

"Either (1) the prior art has already been submitted and rejected, as a matter of law,?by the Federal Circuit during the earlier appeal, or (2) its previous prior art submissions were closer in visual appearance than its new submissions; the new prior art submissions will suffer the same fate."

On the iPhone:

Samsung is not likely to fare much better in its defense against Apple's three iPhone design patents, according to Carani.?The Federal Circuit court has already ruled on what he says was Samsung's best bet -- the so-called?JP'638 patent -- declaring it insufficient to invalidate Apple's patents.?And the infamous F700 (and its related patent KR'895) have both been excluded because Samsung waited until after the court's deadline had passed to introduce them into evidence.

Besides, Carani says, Apple hasn't even begun to exhaust its smartphone patent arsenal:

"Keep in mind that while?it?has?asserted?two?smart phone design patents and one GUI?design patent,?Apple has?dozens of others that they?have not asserted?that are directed at the same products, but having varying scope (some narrower, some broader).??Thus, the main risk to a patentee in a patent case --?having one's patent invalidated --?is largely eliminated in this case.?In other words, even if these design patents are wiped out, there are more in the cupboard.

"Further, and perhaps most significant, Apple has?other?continuation applications pending at the [Patent Office] that Apple can amend and modify pending on the outcome of the case. In sum, as a direct result of its sophisticated design patent acquisition program (which was a central part of Steve Jobs' edict to jumpstart Apple's IP acquisition), Apple now has a high degree of flexibility to maneuver depending which way the case comes out; it can largely mitigate any casualties of litigation. In other words, Apple can add more to the cupboard."

Judge Koh, meanwhile, has plenty of reasons to ask the two company's CEOs to talk one last time. For one thing, the instructions she's been asked to give the jury are more than 100 pages long and will take an hour and a half to read. According to Koh, they're going to "put everyone into a coma."

US June Business Inventories Rose 0.1%; Retail Up 0.6% | ForexLive

WASHINGTON (MNI) ? The value of business inventories rose 0.1% to
another record high level in June, with retail inventories up 0.6% to
add to the factory inventory gain already announced due to sales
declines at both levels, data released Tuesday morning by the Commerce
Department showed.

Analysts in a Market News International survey had expected
business inventories to rise only 0.1% following the unrevised 0.3% rise
in May.

Factory inventories were already reported up 0.1% in the month,
while wholesale inventories fell 0.2%.

Overall business inventories would have been flat in June if a
surge in retail motor vehicle inventories was excluded, an MNI
calculation showed.

Retail motor vehicle inventories were up 1.6% in June as retail
motor vehicle sales fell 0.5% that month. The remaining retail
inventories categories combined for a 0.1% rise in June.

Unlike the nearly across-the-board gains in May, the retail
categories were more mixed in June. There inventory gains in the
clothing, furniture, and food categories, but declines in inventories at
building materials stores and at general merchandise stores.

An MNI calculation of retail inventories not included in the
published categories shows a 0.2% decline in June after rising 0.5% in
the previous month.

Business sales fell 1.1% in June, with retail sales excluding food
services down 0.8% in the month. Wholesale sales were already reported
down 1.4%, while manufacturing shipments, which are equal to sales in
this report, fell 1.1%. The business sales decline was the largest since
a 2.8% decline in March 2009.

Despite the June seasonally adjusted decline, business sales were
still up from a year ago, running 1.5% ahead of their June 2011 level
before seasonal adjustment and up 3.0% after seasonal adjustment.

At the same time, June business inventories were 5.1% above their
year-ago levels before seasonal adjustment and up 5.0% after seasonal
adjustment.

As a result of the inventory rise and sales drop, the
inventory-to-sales ratio rose to 1.29 compared with 1.27 in May. The
June ratio was well above the 1.26 ratio in June 2011 and was the
highest since 1.29 in February 2010. Before seasonal adjustment, the
ratio was 1.24 in June, up from 1.21 in May and 1.20 in June 2011.
