California holds first gay wedding after ban

Gay weddings have begun again in California after a court lifted a ban on them. (AAP)

A lesbian couple who spearheaded a fight for same-sex marriage in California became the first on Friday to tie the knot hours after a ban was lifted, following a landmark US Supreme Court ruling.

Cheers erupted at San Francisco City Hall after Kristin Perry and Sandy Stier exchanged vows in a ceremony conducted by California Attorney General Kamala Harris.

"I now declare you spouses for life," said Harris, after the couple exchanged rings and vows in front of a hastily assembled gathering. "I could not be more honoured to stand here today."

"We have waited a long, long time for this day," said Stier after the ceremony, the first gay wedding since a brief period in 2008 when California allowed same-sex marriage but then banned it under a close-run referendum.

The ceremony came only an hour or two after the Ninth Circuit Court of Appeals in San Francisco lifted the ban on same-sex marriages, imposed under the so-called Prop 8 ballot measure, with immediate effect.

Many observers thought it could be several weeks before marriages would resume in the famously liberal western US state, but the appeals court announced the ban was lifted in a brief ruling posted online.

"The stay in the above matter is dissolved effective immediately," the ruling read, prompting an explosion of online celebration, and hasty wedding ceremony preparations.

Perry and Stier were the first to get married in San Francisco, but they were followed by a long line of other same-sex couples, who rushed to City Hall after news of the unexpectedly early court decision broke.

"Kris and I fell in love 14 years ago. We knew that our relationship would last ... and wanted our love to last and to be dignified by the institution of marriage," said Stier.

Perry told the crowd: "This is the first day of the rest of our lives together, and we could not be more elated by your being here."

Perry and Stier were the plaintiffs in the initial action challenging Prop 8, which wound its way through the legal system before eventually being heard by the top US court.

The Supreme Court ruled that supporters of Prop 8 lacked the proper standing to appeal a lower-court judgment that declared the measure unconstitutional.

The ruling essentially allowed the original federal court ruling to stand, striking down Prop 8.

Supporters of Prop 8 have vowed to pursue their efforts to have the ban - backed by 52 per cent of Californians five years ago, with 48 per cent against - re-enforced.

ProtectMarriage.com, the organisation which supported Prop 8, slammed Friday's court decision.

"This outrageous act tops off a chronic pattern of lawlessness, throughout this case, by judges and politicians hell-bent on thwarting the vote of the people to redefine marriage by any means, even outright corruption," it said.

It added: "The resumption of same-sex marriage this day has been obtained by illegitimate means. If our opponents rejoice in achieving their goal in a dishonourable fashion, they should be ashamed.

"It remains to be seen whether the fight can go on, but either way, it is a disgraceful day for California."

A short time after the San Francisco ceremony, the first gay wedding in Los Angeles was conducted by outgoing Mayor Antonio Villaraigosa, with Paul Katami and Jeff Zarrillo exchanging vows in the city hall.

At one point, the beaming mayor paused as he read out the vows for the two men to repeat after him, telling them: "I don't know about you, but I got goosebumps."

"Let me pronounce you married," he said after the couple had exchanged rings, and before they kissed for the first time as newlyweds.

Conn. man arraigned in ex-Patriot's murder case

ATTLEBORO, Mass. (AP) ? An arrested man from former New England Patriots tight end Aaron Hernandez's hometown was transferred to Massachusetts on Friday to face a gun charge connected to the murder case against Hernandez while a third suspect surrendered to authorities in Florida.

Carlos Ortiz, who lives in Bristol, Conn., and Ernest Wallace, who walked into a South Florida police station, were the men identified earlier as being with Hernandez and the victim the night of his shooting death, a prosecutor said.

Ortiz was charged with carrying an unlicensed firearm in North Attleborough, where Hernandez lives, on June 17, the day Boston semi-pro football player Odin Lloyd was found shot to death near Hernandez's home. Details of the charge weren't released.

Wallace, whose wanted poster was released Thursday night, surrendered in Miramar, Fla., police said. Authorities had been seeking Wallace on a charge of acting as an accessory after Lloyd's murder. Details of that allegation also weren't released.

Police arrested Hernandez on Wednesday at his home and charged him with orchestrating Lloyd's execution-style shooting. Prosecutors said Hernandez orchestrated the killing because Lloyd talked to the wrong people at a nightclub.

Hernandez, Ortiz and Wallace were in a car with Lloyd shortly before his death, Bristol County, Mass., District Attorney C. Samuel Sutter said.

"We now have in custody the three individuals who were in the silver Nissan Altima," Sutter said Friday when Ortiz was arraigned on the gun charge in Attleboro District Court.

All three men have ties to Bristol, Conn.: Hernandez grew up there, Ortiz had been living there, and authorities had conflicting addresses for Wallace there and in Miramar.

Hernandez pleaded not guilty to murder and was denied bail Thursday. Ortiz also was being held without bail pending a court hearing on July 9. Wallace was taken to a jail in Fort Lauderdale, Fla., pending extradition proceedings, police said.

Hernandez's lawyer argued in court that the case is circumstantial. He said Hernandez, who was cut by the Patriots the day he was arrested, wanted to clear his name.

Ortiz's attorney, John Connors, said he will seek bail for his client at the July 9 hearing. He described Ortiz as a "gentle person" and said he will advise Ortiz to plead not guilty.

"I can say that his charge has nothing to do with homicide," Connors said.

It was unclear if Wallace had a lawyer, and he couldn't be reached for comment in jail. His surrender surprised Miramar police.

Wallace walked into the police station and told officers there was a warrant for his arrest, which officers confirmed by checking a computer database.

"He stated he knew he had a warrant because he saw himself on TV," Miramar police Officer Gil Bueno said. "He was very cooperative. It was uneventful."

Earlier Friday, Ortiz appeared in Bristol Superior Court in Connecticut, where a judge authorized turning him over to a Massachusetts state trooper and a North Attleborough officer.

A friend and a relative of Ortiz said outside the courthouse that they were stunned by his arrest. They said Ortiz is the devoted father of two girls and a boy, all under the age of 9. Ortiz was unemployed recently but previously worked a long time at a Savers clothing store, they said.

They also said they couldn't believe Ortiz could be part of a murder.

"He's not that type of person. He has a good heart," said friend Milton Montesdeoca, who added he didn't know Hernandez and never heard Ortiz talk about the football star.

Also Friday, authorities said law enforcement officers recovered in Bristol a car Wallace was seen driving before he surrendered.

Meanwhile, Lloyd's relatives were preparing for his funeral in Boston on Saturday. A relative said the service will be at Church of the Holy Spirit in the city's Mattapan section.

Lloyd played for the Boston Bandits and was dating the sister of Hernandez's fiancee.

Authorities have said trouble that led to Lloyd's killing happened June 14, when Lloyd went with Hernandez to a Boston nightclub. Hernandez became upset when Lloyd began talking with people Hernandez apparently didn't like, prosecutors said.

On June 16, the night before the slaying, a prosecutor said, Hernandez texted two unidentified friends and asked them to hurry to Massachusetts from Connecticut.

A few minutes later, he texted Lloyd to tell him he wanted to get together, prosecutors said. Authorities say the three men picked up Lloyd at around 2:30 a.m. June 17, drove him to an industrial park near Hernandez's home and shot him five times. They have not said who fired the shots.

Prosecutors said an ammunition clip was found in Hernandez's Hummer and matched the caliber of casings found at the scene of Lloyd's killing.

Hernandez was drafted by the Patriots in 2010 and signed a five-year contract worth $40 million last summer. He could face life in prison if convicted.

'Supermoon' Science: Biggest Full Moon of 2013 Explained

On Sunday (June 23), the moon will be at its closest point to Earth ? called perigee. This relatively close brush will happen as the moon enters its fullest phase, creating the cosmic coincidence known as the supermoon. "It doesn't matter where you are, the full moon you're seeing will be the biggest for 2013," Michelle Thaller, the assistant director of science at NASA's Goddard Space Flight Center said. "? That 12 percent size different can mean as much as a 30 percent change in the brightness, so this will be a particularly bright supermoon."

How to see the supermoon

Weather permitting, everybody should be able to see the supermoon. The moon will be rising from the east right around sunset, Thaller said. It will appear huge and low on the horizon before rising brightly into the sky for the night. Saturday and Sunday should both be ideal viewing opportunities.

You can also watch a live webcast of the supermoon on SPACE.com beginning on Sunday beginning at 9 p.m. EDT (0100 June 24 GMT), courtesy of the online Slooh Space Camera, an online skywatching website (http://www.slooh.com).

A changing distance

Supermoons occur about once annually, and this year, the supermoon is closer than it has been in a little while, Thaller said.

The distance from the Earth to the moon varies along the rocky satellite's elliptical orbit. Perigee differs from month to month, so sometimes the supermoon is a little closer or further away, Thaller said.

"The closest the moon gets can actually vary much as much as the diameter of the Earth," Thaller said. "That seems like a pretty big number, but the moon is actually 30 times the diameter of the Earth away from us. If you line up 30 Earths, that's about the average distance of the moon away, but as it swings a little bit closer to us, that distance can vary."

The sun can be to blame for the difference in distance. In the winter, when the Earth is closest to the sun, a supermoon could be even closer and more stunning, Thaller said. The strength of the sun's gravity pulls both the moon and the Earth towards it slightly, making the moon dip closer to the planet.

Science from a supermoon

Although it might be a brilliant skywatching opportunity, not a lot of scientific research comes from the supermoon. Scientists prefer to study the moon from a closer vantage point, Thaller said.

"The supermoon for [scientists] is a fun chance to talk about the changes in the sky [and] observing the universe," Thaller told SPACE.com. "As scientists, we like to observe the moon a little bit closer up and right now we have LRO, the Lunar Reconnaissance Orbiter, a spacecraft actually orbiting the moon. We're taking these incredible high resolution pictures of the entire lunar surface."

Some numbers went up in the revised budget, and some went down ? like the administration?s estimated tax revenues for online gaming in the next fiscal year.

But as you?ll see, even the new number seems just a bit on the rosy side:

The estimated tax revenue for the online casino game offerings has been adjusted from $180 million to $160 million. Here?s the problem:

- A Wells Fargo analysis that foresees $1.5 billion worth of online gambling in the state as of the five-year mark is the blueprint for the administration?s figures, apparently. They estimated a $1.2B first-year mark, and at a 15 percent tax rate, there?s your original $180M.

- But if you look closer, the same report has a startup year figure of $650M to $850M. Split the difference and make it $750M, and that?s only $112.5M, not $180M ? or even $160M.

- The next problem is that the state?s fiscal year begins July 1. But the state isn?t expected to begin offering the games until late this fall, after Atlantic City casinos have made formal applications and the technology infrastructure is put in place. So $112.5M becomes closer to $75M if you shave off four months ? and even that likely is generous. So now we?re still at less than half the new claimed amount of $160M.

- More problems: The Wells Fargo estimate seems to be a but of an outlier. A December 2010 analysis provided for iMega, the online gambling industry?s lobbying arm, estimated revenues that would only lead to about $35M or so in the first full year. Two months ago, industry research firm Gambling Data?s figures would mean $39M in the first year of operation.

- Cut those two numbers by one-third to account for the less than full year of revenues in the first fiscal year, and you?re looking at roughly $25M ? not $160M.

A Treasury Department spokesman told me then that there were indeed ?widely varying estimates.? True, but the highest ones of all belong to the Governor?s office.

Meanwhile, one claim for a higher-than-expected rookie year could be that the brand name of PokerStars would instantly lure countless players to sign up immediately. But PokerStars is appealing a court ruling that voided its deal to buy The Atlantic Club ? and ownership of an AC casino is a must for would-be online gaming operators.

If PokerStars can?t right that ship in time, that surely will put a damper on first-year figures ? in part because some New Jersey-based brand-loyal players will be slower to embrace competing sites.

No one can say for sure if the administration?s numbers will be proven accurate. But based on all the evidence, it sure looks like a longshot.
